Arbitration

Parties in dispute are often concerned about the rising delays and costs of courtroom litigation, along with the uncertainty of leaving a decision in the hands of a judge or jury with a lack of specialized knowledge of a commercial matter. Arbitration before an experienced arbitrator provides a dynamic and confidential alternative. As a commercial arbitrator, Lorraine leverages her extensive experience handling financial and risk management issues, both domestic and international,  in order to synthesize complex issues and render a firm, fair and impartial decision.

Mediation

In a mediation process, the mediator facilitates negotiations between disputing parties to help them find a mutually acceptable outcome. Mediation provides a less expensive and more efficient alternative to litigation, and enables the parties to seek settlement under the guidance of a skilled mediator. Lorraine uses her structuring skills to serve the parties by “greasing the wheels”. In confidential sessions with each party and counsel, she builds trust, reviews the strengths and weaknesses of the case, seeks to address the party’s real underlying interests, and explores practical business solutions for resolution. Through joint sessions, she helps the parties find areas of common ground. Once an agreement is reached, Lorraine assists the parties in drafting a formal written settlement agreement.

American Arbitration Association (AAA)

Lorraine serves on the commercial arbitration and mediation panels of the American Arbitration Association. Given her subject matter expertise, her focus has been on commercial cases involving breach of contract, partnership and joint venture agreements, business transfers, employment disputes, and trademark/copyright disputes, and disputes between insurance companies or between policyholders and their insurers.

Financial Industry Regulation Authority (FINRA)

Lorraine serves as a neutral non-public arbitrator with FINRA, the preeminent forum providing dispute resolution services for investors, employees and brokerage firms. Her cases have focused on breach of contract, structured finance and employment related disputes across constituents of the securities industry.

New York State Unified Court System

Lorraine has been accepted as a Special Master, Appellate Division, New York Supreme Court, Second Judicial Department. She serves on the commercial and civil mediation rosters for the judicial districts of the New York State Supreme Court, including, Brooklyn, Queens, Westchester, Bronx, and Nassau County. In addition, she arbitrates and mediates on a pro bono basis for New York’s Part 137 attorney-client fee dispute resolution program.
